Reservations for accommodation by Guest (the Holiday Maker) are accepted by Philip Butler (the Owner).

The Agreement: The rental agreement is between the Holiday Maker and the Owner. The contract is deemed to have been made once the Holiday Maker has paid a deposit and the owner has dispatched a confirmation of booking. The Holiday Maker must be over 18 years of age at the time of booking.

The Property (Property) is the apartment known as 4a Channel View, Bexhill, East Sussex, TN40 1JT. The Property trades under the name Absolute Beachfront.

 

COVID 19: Should the Holiday Maker be unable to travel due to Government travel restrictions or the host have to close due to Government restrictions the Holiday Maker will be refunded in full.

 

Booking: The Holiday Maker who makes the booking is deemed to have agreed to these Terms and Conditions and will be responsible for all persons included in the booking and should ensure that they are all aware of these Terms & Conditions. The Owner reserves the right to decline any booking or refuse to hand over a key to any person who has not complied with these Terms & Conditions.

 

Payment: For bookings made more than six weeks before arrival, a deposit (part payment) of 25% of the total cost of the holiday, is required. The balance is due six weeks before the holiday commences. For bookings made less than 6 weeks before arrival, the total amount is payable in full on booking.

The Holiday Maker agrees to pay the balance of the payment six weeks before the holiday is due to start. Email reminders are sent, but delivery cannot be guaranteed. Where a Holiday Maker fails to pay their balance by the due date the booking may be cancelled, and the deposit retained.

 

Number of people using property: The owner permits the Holiday Maker and members of the Holiday Maker's party (but no one else) to occupy the property for holiday purposes only. The Holiday Maker must declare the correct number of additional Holiday Makers during booking and, if this changes, must inform the Owner before the rental commences of any change. No more than six people may occupy a property unless by prior written agreement with the Owner.

 

Arrival/Departure: The property will be available for occupation from 2pm on the first day of the holiday and must be vacated by 10am on the last day.

 

Cancellation or Changes by the Holiday Maker: Cancellations must be notified in writing (including by email) to the Owner immediately. The Owner will endeavour to re-let the property and if successful may at their discretion allow the Holiday Maker to transfer to alternate dates for a £20 administration fee plus any other expenses incurred in re-letting. The expenses incurred in re-letting will be at the discretion of the Owner. The owner recommends and expects that the Holiday Maker will have or will take out a holiday insurance policy (which includes cancellation insurance covering sickness and unavoidable reasons for cancellation) prior to their stay.

 

Holiday Maker Promises:

In this paragraph, a promise by the Holiday Maker not to do something also implies that the Holiday Maker will not allow anyone else to do that same thing. The Holiday Maker now promises that he will:

·        Keep the interior of the Property in clean and good repair and condition;

·        Not to smoke in the property or allow cigarette smoke to enter the property;

·        Pay for any necessary repairs or replacement goods damaged during the letting period;

·        Use the Property only as a holiday home for no more people than the maximum occupancy stated above and will not operate a business at the property or use it for any improper, immoral or illegal purpose;

·        Not assign, sublet, charge or part with or share possession or occupation of all or part of the Property;

·        Not cause nuisance or annoyance to the Owner, other Holiday Makers or any neighbour;

·        Not change or remove any of the Owner's furniture, fixtures and fittings or items on the inventory;

·        Not change or install any locks on any doors or windows nor have additional keys made for any locks without the prior written consent of the Owner;

·        Not keep or allow pets of any kind on the Property unless agreed in writing with the owner prior to booking;

·        Report to the Owner any disrepair or defect in respect of the Property or the fixtures and fittings and report any failure of mechanical or electrical appliances;

·        Allow the Owner, his agent or contractors access to the Property at reasonable hours during the day, or to carry out urgent and unforeseen repairs or other works to the Property or to carry out maintenance of the appliances. The Owner will normally give at least 12 hours notice but the Holiday Maker will give immediate access in an emergency;

·        Whenever the Property is left unattended, the Holiday Maker will secure the property by locking doors and closing windows to prevent unauthorised access to the Property.

·        Ensure the supervision of children, babies and any adults requiring care remains the responsibility of the Holiday Maker at all times. Holiday Makers should put all furniture etc back to where it was at the beginning of the rental period. Holiday Makers should not leave any items at the property and, if left, the owner has the right to charge for the removal, return or disposal of those items.

 

If, in the opinion of the owner, any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to other parties, the contract may be treated by the owner as discharged and the owner may repossess the property immediately. The Holiday Maker will remain liable for the whole cost of rental and no refund shall be due.

 

Insurance: The Owner will maintain whatever insurances he wishes against any risk relating to the apartment. He will not insure anything owned by the Holiday Maker. The Holiday Maker will not do, nor allow anyone else to do, anything that could adversely affect the Owner's insurance of the Property. If the Holiday Maker does anything that prejudices the Owner’s insurance, he will be liable to the Owner for any resulting loss.

 

Disputes: No complaints can be considered unless notified during the Holiday Maker's stay in the property. It is the duty of Holiday Makers to minimize any loss to them and therefore it is their responsibility to inform the owner at the earliest possible opportunity of any problem. Complaints received after departure cannot be accepted as the Owner thereby has no opportunity to resolve the complaint at the time. The Holiday Maker agrees that the contract with the owner is made at the owner's premises and that any proceedings between the parties shall be conducted in the County Court nearest to the owner.

 

Liability: The owner cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property, its plumbing, gas, electrical services or exceptional weather. No responsibility is accepted for loss or damage of property, (including pets), vehicles or vehicle contents belonging to the Holiday Maker or any member of the party during their occupancy.

The maximum liability accepted by the owner will be the total cost of the holiday as paid by the Holiday Maker to the owner. No other expenses such as travelling costs or alternative accommodation will be accepted.

 

Cancellation by Owner: The owner reserves the right to refuse any booking and to cancel any bookings already made if the property is unavailable (eg through fire, flood, etc) for any reason whatsoever, subject to a full refund of all monies paid (but no further liability). The owner shall not be under any other liability if such cancellation occurs.

 

Force Majeure: The owner cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside our control.

 

Waiver: The failure of the owner to enforce or exercise, at any time or for any period of time, any term of, or any right pursuant to this agreement does not constitute and shall not be construed as a waiver of such term or right.

 

Holiday Maker’s departure

At the end of the tenancy the Holiday Maker will:

·        Immediately return all the keys of the Property to the Owner or comply with such arrangements for the return of the keys as the Owner reasonably suggests before the commencement of the tenancy;

·        Remove all personal effects and rubbish and leave the Property and the Owner's fixtures and fittings in the same clean condition and state of repair as at the start of the holiday.
